Installing an app from the App Store means that Apple’s EULA applies.
Permitted Use
You may use PocketMDM without restrictions for its intended purpose. Malicious usage is strictly prohibited.
User Responsibility
You acknowledge and agree that:
- Your use of PocketMDM is at your sole risk.
- You are solely responsible for any decisions, actions, or outcomes resulting from your use of PocketMDM.
- You will not use PocketMDM in a manner that violates any applicable laws, regulations, or third-party rights.
Intellectual Property
You may not reproduce, modify, distribute, or exploit any part of PocketMDM without explicit permission. All content, features, and functionality are owned by the developer of PocketMDM and are protected by intellectual property laws.
Disclaimer of Warranties
PocketMDM is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, PocketMDM’s developer expressly disclaims all warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy,
reliability, or availability. PocketMDM’s developer does not warrant that PocketMDM will be error-free, uninterrupted, secure, or free of harmful components.
Limitation of Liability
To the maximum extent permitted by law, in no event shall PocketMDM’s developer, its affiliates, partners, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
- Personal injury
- Loss of data
- Loss of profits
- Device damage
- Business interruption
or any other commercial damages or losses, arising out of or in connection with your use of, or inability to use, PocketMDM, regardless of the theory of liability (contract, tort, or otherwise) and even if PocketMDM’s developer has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless PocketMDM’s developer, its affiliates, partners, and licensors from and against any and all claims, damages, liabilities, losses, and expenses (including legal fees) arising from your use of PocketMDM, your violation of these Terms, or your violation of any third-party rights.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles.
You agree that any dispute, claim, or controversy arising out of or relating to PocketMDM or these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in Greene County, Ohio, and you consent to the personal jurisdiction and venue of the courts located in Greene County, Ohio, for any matters not subject to arbitration.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
